Terms & Conditions: Rental Blue Bird Residence
BETWEEN PARTIES
GMMC NV, De Breem 11 2350 Vosselaar, RPR Antwerp, Turnhout division 0449.994.975, bank account number BE83 1325 5414 8715, BIC number BNAGBEBBXXx, VAT BE 0449.994.975, represented here by virtue of special power of attorney by Christophe DE WEER, hereinafter referred to as: “Lessor”.
AND
The tenant’s contact details are listed in the confirmed reservation form, hereinafter referred to as “Tenant”.
HAVE AGREED
Article 1 – Description of leased property
1.1 The lessor leases to the Tenant and the Tenant rents from the Lessor a furnished flat located at Moriaanstraat 10 in 2000 Antwerp, hereinafter referred to as: “the Leased Property”.
Article 2 – Purpose of the leased property
2.1 The Tenant will use the Leased Property exclusively as a temporary residence without the right to establish a domicile there, to set up a seat for a company or association or to carry out any commercial or professional activity without the prior written consent of the Lessor, the Tenant may not use the Leased Property for any other purpose.
2.2 If the Tenant acts in violation of this article, he shall be liable to pay immediately due compensation, without prejudice to the Lessor’s right to claim additional compensation for the damage suffered.
Article 3 – Duration of the agreement
3.1 The rental agreement starts and ends on the dates specified in the confirmed reservation form.
3.2 The Tenant can check in from 4 pm on the scheduled day of arrival and must check out before 10 am on the scheduled day of departure of the rental period. Access will be granted by the Lessor by handing over a key. If not, the Lessor will send coordinates by SMS or e-mail to enter the Leased Property using a key safe.
Article 4 – State of maintenance
4.1 The Lessor shall make the Leased Property available to the Tenant in the condition it is in on the effective date of the lease.
Article 5 – Rental price
5.1 The price of the rented property is stated in the confirmed reservation form. The payment of the rental fee be received in the Lessor’s designated account (IBAN: BE83 1325 5414 8715) before check-in on the arrival date.
Article 6 – Security deposit
6.1 The security deposit is 300,00 EUR and is used for minor repairs that do not exceed this amount.
6.2 The payment of the security deposit be received in the Lessor’s designated account (IBAN: BE89 1325 4310 7485) before check-in on the arrival date.
6.3 The security deposit may also be handed over in cash upon arrival.
Article 7 – Cancellation policy
7.1 The Tenant must give the Lessor timely written notice of a cancellation request.
7.2 Tenant receives 100% refund if canceled more than 10 days before check-in.
7.3 Tenant receives 50% refund if canceled more than 5 days and check-in.
7.4 Tenant receives 0% refund if canceled less than 5 days and check-in.
Article 8 – Proper use of the leased object
8.1 The Tenant undertakes to use the Leased Propery only for the purpose specified in Article 2 of this contract. He shall comply with the general directives of the Lessor and shall ensure that neither he nor the persons who use the Leased Property pursuant to this agreement commit acts contrary to public order, good morals and prohibited acts.
8.2 The Tenant undertakes not to cause any nuisance or nuisance to local residents or the surrounding area.
8.3 The Tenant shall take appropriate measures to prevent damage to the Leased Property. Damage that occurs or threatens to occur to the Leased Property must be reported to the Lessor in writing immediately.
8.4 The Tenant is strictly prohibited from making any modifications to the Leased Property, including the building itself, its furnishings, and any movable items.
8.5 The Lessor waives recourse against the Tenant.
Article 9 – Obligations of the Tenant regarding maintenance and repair
9.1 Any damage to or decrease in the value of the Leased Property due to fault or negligence on the part of the Tenant, whether or not in performance of the Tenant’s duties, will be recovered from the Tenant.
Article 10 – Sublease
10.1 The tenant is not allowed to sublet the Leased Property in full or in part to third parties without prior written permission from the Lessor.
10.2 If the Tenant acts contrary to this article, he shall be liable for an immediately payable fine.
10.3 If additional guests stay in the Leased Property during the rental period, the Tenant is obliged to notify the Lessor in advance and additional costs will be charged. The Tenant is obliged to pay these to the Lessor account number. The maximum capacity is 4 guests per unit.
Article 11 – Pets
11.1 The Tenant is only allowed to keep pets if he has received prior written access from the Lessor.
11.2 If the Lessor has given written permission to keep pets, they may not cause any nuisance. Pets may not be left alone in the Leased Property.
11.3 If the Tenant contravenes this article, he shall be liable for an immediately payable fine, without prejudice to the obligation to immediately remove all pets present from the Leased Property.
11.4 If a pet is allowed by the Lessor in writing to the Tenant in the Leased Property, an additional cost of EUR 20.00 per animal will be charged.
Article 12 – Smoking policy
12.1. Smoking is strictly prohibited inside the building, including all interior areas, rooms, common spaces and patio on the ground floor.
12.2. Smoking areas are available outside the building on the street: Moriaanstraat.
12.3 If smoking is detected inside the building, the Tenant will be held responsible and subject to a fine of 300 EUR.
12.4 In the event that smoking occurs inside the building, resulting in lingering odors, stains, or damage to furnishings, the tenant will be responsible for any additional cleaning or repair costs incurred.
12.5. Any necessary cleaning or repair costs will be deducted from the security deposit or charged separately to the tenant.
Article 13 – Access to the hired room
13.1 The Lessor and all persons designated by him are entitled to enter the Leased Property after consultation with the Tenant for the purpose of carrying out (repair) work on the Leased Property and inspection of the condition of the Leased Property.
13.2 In emergencies the Lessor shall also be entitled to enter the Leased Property without consultation.
Article 14 – Termination of the tenancy agreement
14.1 The Tenant has no possibility of early termination of the agreement.
14.2 The Lessor shall have the option to terminate the agreement early if the Tenant fails to fulfil his obligations under this agreement.
Article 15 – End of rental agreement and handover
15.1 At the end of the tenancy agreement, the tenant shall return the rented property swept clean and with keys.
15.2 In case of loss of a key, the Lessor will charge the Tenant the full cost of replacing the key and/or lock.
15.3 The Tenant shall inform the Lessor of any damages incurred during the stay.The Landlord will conduct a unilateral inspection of the Leased Property after the stay.
15.4 The Landlord will provide a cost estimate for the necessary repairs.
15.5 If the security deposit does not cover the repair costs, the Tenant shall make additional payments to restore the Leased Property to its original condition.
Article 16 – Penalty clause
16.1 If the Tenant violates any provisions mentioned in the above articles, he forfeits to the Lessor an immediately payable fine of EUR 1,500.00 as well as an amount of EUR 25.00 per day for every calendar day that the violation continues with a maximum of EUR 5,000.00.
16.2 This penalty shall not affect the Lessor’s right to claim full damages.
Article 17 – Consequences of nullity or voidability
17.1 If any part of this rental agreement is void or voidable, this shall not affect the other provisions of the agreement. A provision that is void or voidable shall in that case be replaced by a provision that comes closest to what the parties had in mind when concluding the agreement on that point.
Article 18 – Applicable law and competent court
18.1 Belgian law shall apply to this agreement.
18.2 In the event of any disputes, the court in the district where the Leased Property is located shall have jurisdiction.
